     The Senate met at 6 p.m.
(Senator Tomblin, Mr. President, in the Chair.)

     Prayer was offered by the Honorable Brooks F. McCabe, Jr., a senator from the seventeenth district.
     Pending the reading of the Journal of Wednesday, March 17, 2004,
     On motion of Senator Love, the Journal was approved and the further reading thereof dispensed with.
     The Senate proceeded to the third order of business.
Executive Communications

     The Clerk then presented a communication from His Excellency, the Governor, advising that on March 18, 2004, he had approved Enr. Senate Bill No. 199, Enr. Senate Bill No. 296 and Enr. Senate Bill No. 471.
     The Senate proceeded to the fourth order of business.
     Senator Rowe, from the Joint Committee on Enrolled Bills, submitted the following report, which was received:
     Your Joint Committee on Enrolled Bills has examined, found truly enrolled, and on the 18th day of March, 2004, presented to His Excellency, the Governor, for his action, the following bills, signed by the President of the Senate and the Speaker of the House of Delegates:
     (S. B. No. 100), Prohibiting state and political subdivisions from contracting with vendors owing debt to state.
     (Com. Sub. for S. B. No. 181), Permitting retired state police to carry concealed weapon for life.
     (S. B. No. 469), Continuing interstate commission on uniform state laws.
     (S. B. No. 470), Continuing real estate appraiser licensing and certification board.
     (S. B. No. 506), Permitting use of "bank" in name of licensed insurance company.
     (S. B. No. 563), Relating to public employees retirement act.
     And,
     (S. B. No. 576), Continuing state rail authority.

     The Senate proceeded to the twelfth order of business.
     Remarks were made by Senators Bowman, Sprouse, Prezioso, Weeks, Ross and Deem.
     Senator Bailey then moved that the Senate adjourn until tomorrow, Friday, March 19, 2004, at 11 a.m.
     The question being on the adoption of Senator Bailey's motion, and on this question, Senator Bailey demanded the yeas and nays.
     The roll being taken, the yeas were: Bailey, Boley, Bowman, Caldwell, Dempsey, Edgell, Harrison, Helmick, Jenkins, Kessler, McCabe, Minard, Minear, Plymale, Prezioso, Ross, Rowe, Sharpe, Snyder, Unger, Weeks, White and Tomblin (Mr. President)--23.
     The nays were: Deem, Fanning, Hunter, Love, McKenzie and Sprouse--6.
     Absent: Chafin, Facemyer, Guills, Oliverio and Smith--5.
     So, a majority of those present and voting having voted in the affirmative, the President declared Senator Bailey's motion had prevailed.
     In accordance with the foregoing motion, the Senate adjourned until tomorrow, Friday, March 19, 2004, at 11 a.m.
